The following is a mutually agreed-upon contract between WebHostingPad and all customers, affiliates, subscribers, clients, or anyone using WebHostingPad’s services, henceforth referred to as “you”. The spirit of these terms is to ensure you and all customers are using WebHostingPad services with due regard to the rights of other internet users and in conformity with the requirements of WebHostingPad’s network environment.

The terms of service are not exhaustive, and WebHostingPad reserves the right to add, delete, or modify any provisions set forth at any time, without notice, effective upon posting to WebHostingPad.com. These terms supersede any other agreement, whether it be written, oral, or by conduct, unless expressly agreed to the contrary in signed writing by an authorized representative of WebHostingPad. Unless otherwise stated, all sections of these terms apply universally, and cover all other sections of this agreement, regardless of placement, formatting, URL, or numbering.

Nothing in this agreement will be construed as created a partnership or relationship of employer and employee, principal and agent, partnership, or joint venture between WebHostingPad and its customers. Each WebHostingPad and its customers are deemed an independent contractor at all times and has no right or authority to assume or create any obligation on behalf of the other unless expressly provided herein.

These terms and all agreements for WebHostingPad services will be governed and construed in accordance with the laws of the State of Illinois, USA. Any litigation or arbitration between a customer and WebHostingPad will take place in Illinois, and the customer will consent to personal jurisdiction and venue in that jurisdiction. If any provision or portion of these terms of service or other WebHostingPad agreement is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of these terms of service or the agreement will continue in full force and effect.

Legal Terms
  • Governing Law And Severability
    The terms of service, and any other agreement for HostMetro services, will be governed by and construed in accordance with the laws of the State of Illinois, USA without reference to its conflicts of laws principles. Any litigation or arbitration between a customer and HostMetro will take place in Illinois, and the customer will consent to personal jurisdiction and venue in that jurisdiction. If any provision or portion of the terms of service or other HostMetro agreement is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of the terms of service or the agreement will continue in full force and effect.
  • Website Ownership
    The legal ownership of all websites, website files, and accounts with HostMetro is the individual or organization who is listed on the Account Information in the HostMetro database. Customers must cooperate completely with and abide by any and all of HostMetro's security measures and procedures.
  • Complete Agreement And ExclusivityThe terms of service, and/or any other specific agreement for HostMetro services, constitutes the complete understanding and agreement between HostMetro and its customers. Except when expressly agreed to the contrary in signed writing by an authorized representative of HostMetro, the terms of service supersedes any other written (including digitized/computerized) agreement, oral agreement, and/or agreement by conduct. This terms of service, and/or any other specific agreement for HostMetro services is between HostMetro and its customers only and will not confer any rights in any third party except as otherwise expressly provided by HostMetro.
  • Copyright Violations
    All HostMetro customers are required to follow the laws set forth by the Digital Millennium Copyright Act (DMCA). In the event that HostMetro receives a DMCA complaint with regard to the content on a customer's website or hosting account and the complaint meets the following criteria, the account will be suspended and/or terminated at HostMetro's sole discretion. HostMetro requires the following information for DMCA Copyright Infringement. 1) A physical or electronic signature of the copyright owner. 2) Identification of the copyrighted material claimed to have been infringed. 3) Location of this material on the website/hosting account. 4) Copyright holder's name, address, and telephone number. 5) A statement claiming that the copyright owner has belief that use of the material is not authorized. 6) A statement, under penalty of perjury, that the information in the notification of copyright infringement is accurate.   • Disclaimer
    All services provided by HostMetro are provided to the customer "as is" with no warranty or condition of any kind, either expressed or implied. HostMetro makes no representations or warranties that the services will (a) meet your requirements, or (b) the services will be uninterrupted, timely, secure, or error free. HostMetro will not be held liable for any damages or losses a customer's business may suffer. HostMetro is not responsible for any reimbursement for losses of income due to disruption of services.
  • Indemnification
    HostMetro customers agree to protect, defend, hold harmless, and indemnify HostMetro, any third party entity related to HostMetro (including, without limitation, third party vendors), and HostMetro executives, directors, officers, attorneys, managers, employees, consultants, contractors, agents, parent companies, subsidiaries, and affiliates, from and against any and all liabilities, losses, costs, judgments, damages, claims, or causes of actions, including, without limitation, any and all legal fees and expenses, arising out of or resulting in any from the customer's use of HostMetro services.

  • These Terms May Change
    We reserve the right to revise or change any portion of the terms at any time without advanced notice. Any changes will be effective upon posting the revisions to this website. The most current version of our terms will always be located on this page. Your continued use of our hosting following the posting of any changes will constitute your acceptance of said changes. If you do not agree to the changes made to the terms, please immediately terminate your account
